October 1, 2008 - Alan Gaynor Recognized for Contributions to Community and Rotary Club of Savannah Alan Gaynor, a former partner and special counsel at Bouhan, Williams & Levy, LLP, was honored by the Rotary Club of Savannah on Monday, August 11, 2008, for his many years of service and dedication to the community and the Rotary Club. Below is an excerpt from that recognition.  Bouhan, Williams & Levy is very proud of Mr. Gaynor’s service to the community and his accomplishments.

“Trust, Honesty, Leadership, Knowledge, Tradition, Community Service – These are several of the qualities which describe the 63rd President of the Rotary Club of Savannah, Alan Gaynor, serving during the period 1975-76.”

Alan was born in Savannah in 1928. After graduating from the University of Virginia with a BA in 1950 and Law Degree in 1953, Alan was accepted by the Air Force and proudly served on active duty as Captain in the Judge Advocate General’s Department.
 
In 1954, Alan returned to Savannah and began his career at Bouhan, Williams & Levy as a member of the State Bar of Georgia. In 1985-86, Alan was elected President of the Savannah Bar. In 1994, Alan became “Of Counsel” at Bouhan, Williams & Levy.
 
Community service was a very important part of Alan’s life. From 1966-72, Alan served in the Georgia House of Representatives. He was Chair of the Georgia Commission on the National Bicentennial Celebration as well as Chair of the Savannah Bicentennial Commission.
 
Alan was active on several community boards, including being Founding Director and Secretary of Goodwill Industries of the Coastal Empire, Georgia Historical Society, Telfair Academy, United Way, Little Theatre and Downtown Neighborhood Association.
 
Alan Gaynor was very involved with Boy Scouts since his childhood. Scouting helped Alan during his many moves during his youth, allowing him to easily meet new friends in new cities. In 1944, Alan attained the rank of Eagle Scout. After college, Alan began to give back to scouting. He was a Scoutmaster of Troop 12 at First Presbyterian Church for about 14 years and associated with that troop for more than 20 years. Nearly 25 boys became Eagle Scouts during this time with Troop 12. John Lientz, a law partner with Alan, was an Eagle Scout under Alan. Alan tells me that as Sr. Patrol leader, John refused to follow in the footsteps of others by making coffee for Alan at each weekend camping trip. In spite of this shortcoming, John still was able to attain the rank of Eagle Scout and counts Alan as a colleague and close friend.
 
In addition to the local Scout troop, Alan was very active in the Order of the Arrow, the honor society of the Boy Scouts, whose main purpose is to promote camping among Boy Scout troops. He served as advisor to this organization for many years. His work with this organization earned him National honors, including the “Distinguished Service Award” in 1971.
 
Alan’s work with the Boy Scouts did not stop there. He was also very active with the Coastal Empire Council of the Boy Scouts, serving on its board as a member and Vice President. His dedication to the Scouting movement earned him the highest honor presented to adult leaders, the “Silver Beaver Award.”

June 1, 2008 - Attorney Frank W. Seiler Nominated for the Prestigious Secretary of Defense Employer Support Freedom Award Savannah, GA – Bouhan, Williams & Levy LLP is honored to announce one of its leading attorneys, Frank “Sonny” Seiler, was nominated for the prestigious Secretary of Defense Employer Support Freedom Award. 

Seiler was nominated for the award by an employee serving in the National Guard/Reserve for giving exceptional support above the requirements of federal law. 

Each year, National Guard and Reserve members are invited to nominate employers who show exceptional leadership, support and personal devotion to the National Guard and Reserve.  The 2008 recipients will be announced mid-summer and honored at the 13th annual Secretary of Defense Employer Support Freedom Award ceremony in September in Washington D.C.

May 19, 2008 - Bouhan, Williams & Levy Lawyers Selected for Georgia Super Lawyers 2008 Savannah, GA – Bouhan, Williams & Levy LLP is honored to announce that seven of its lawyers have been selected for inclusion in the Georgia Super Lawyers 2008.  Georgia Super Lawyers is a prestigious honor presented to the top five percent of lawyers in the state by Atlanta Magazine.

April 15, 2008 - Attorney Frank "Sonny" Seiler Publishes Article in Georgia Backroads Magazine Savannah, GA – Frank “Sonny” Seiler recently published an article in Georgia Backroads Magazine.  Seiler’s article titled Matthew Batson’s Magnificent Flying Machine was a feature story in the Spring 2008 issue of Georgia Backroads, an award-winning magazine devoted to Georgia history, nature and travel.

Seiler’s nonfiction article describes Matthew Batson’s quest for flight.  Through easy prose and historical pictures, Seiler details how little known Batson became a well-respected visionary in early 20th century aircraft design.  Seiler guides the reader step by step through Batson’s rise and his unfortunate fall in the summer of 1915.  Batson’s story is given new life through Seiler’s masterful retelling.  The article is rich with historical fact and aviation history.  Through Seiler’s words, Batson’s vision and hopes will inspire for generations to come.

Seiler is a leading attorney for Savannah based law firm Bouhan, Williams & Levy LLP. Seiler was selected for 2008’s Super Lawyers and Best Lawyers.  He has held several positions of note including President of the State Bar of Georgia, as well as serving on the Board of Governors of the State Bar of Georgia.  Seiler also co-authored with Kent Hannon the book Damn Good Dogs! April 1, 2008 - Augusta Jury Finds in Favor of Doctor in Medical Malpractice Case Savannah, GA – On March 26, 2008, after approximately four hours of deliberations, a jury of 12 unanimously found no negligence on the part of Dr. Lynn Tucker and returned a verdict for the defendants, Dr. Tucker and University Surgical Associates. Dr. Tucker and University Surgical Associates were represented by Frank “Sonny” Seiler and Carlton E. Joyce with the law firm of Bouhan, Williams & Levy in Savannah, Georgia.

Ernest Gough, whose wife died of cancer, sued Dr. Tucker and University Surgical Associates for medical malpractice.  Mrs. Gough, who was 20 weeks pregnant, detected a small lump in her right breast.  Dr. Tucker arranged for her to have an ultrasound performed and scheduled an appointment for Mrs. Gough to see her once the ultrasound had been completed.  The ultrasound was performed and was found to be inconclusive, so the radiologist recommended that she have a biopsy.  When Dr. Tucker saw Mrs. Gough in her office 10 days later, the lump was smaller.  Dr. Tucker advised Mrs. Gough to return to see her in one month for a follow up visit.  Mrs. Gough never returned for the scheduled follow visit with Dr. Tucker, nor did she report any problems to any other physicians.  Mrs. Gough did not disclose to Dr. Tucker that her family had a history of cancer and that she had seen her family physician, Dr. Frank L. Carter, for discharge from her right breast two years before she approached Dr. Tucker about the lump.  By the time Mrs. Gough returned to see Dr. Tucker in October of 2003, Mrs. Gough had stage 3 breast cancer.  She died in May of 2004.

For the defense, Joyce argued that Dr. Tucker did everything medically possible to treat Mrs. Gough after she returned to her care.  Further the defense argued that Mrs. Gough was contributory negligent in withholding critical information from Dr. Tucker which could have dictated a different course of treatment.

March 3, 2008 - Carlton E. Joyce Presents Paper on A Federal Trial Judge's Right to Comment on Evidence Savannah, GA – Carlton E. Joyce, an attorney with the law firm of Bouhan, Williams & Levy LLP, presented a paper on a federal trial judge’s right to comment on evidence to the Federal Court Advisory Panel to the Southern District of Georgia in February of 2008.

The paper, which was co-authored by Water Hartridge, questions whether Judge Emory Speer correctly used the right to comment on the evidence in the celebrated 1906 case of United States v. Greene & Gaynor or if he ‘went too far.’ Through historic record Hartridge and Joyce demonstrate how Judge Speer’s comments affected the verdict.  They also use a similar case opinion written by Senior Circuit Judge Hill in Wilson v. Bicycle South, Inc. as another example of a judge using the right to comment on evidence. 

It is a widely held belief that Judge Speer let his personal bias affect the jury process.  Hartridge and Joyce showed that he did not remain neutral and he became an advocate for the prosecution.  According to their findings, Judge Speer’s actions severely prejudiced the defense and evidentially led to a congressional inquiry whether he should be impeached.
